Toilets

1.0 HIRING AGREEMENT—GENERAL

1.1 The hirer acknowledges that he is not relying upon skill or judgement of, or any

representation made by, or on behalf of Centofanti Builders Pty Ltd trading as

Riverland Temporary Fencing A.C.N 110 698 461 A.B.N 98 110 698 461 hereafter

known as the Owner, in respect to the equipment or its performances.

1.2 The equipment is hired to delivery address advised by the Hirer and is not

transferable to any other site or Hirer.

1.3 The Hirer shall inspect the equipment within 24 hours of installation/delivery and immediately notify the Owner in writing of any objection to or defect in the

equipment. The Hirer’s failure to do so shall constitute an acceptance of the

equipment “as is” and deemed acknowledgement that the equipment is in good repair and condition, is safe, useable and the quantity installed is correct. Upon

timely receipt of a notice of legitimate objection or defect, the Owner shall, within

a reasonable time, cure the problem within reason. The liability of the Owner in

respect of any matter arising out of the application of the Trade Practices Act or

any other applicable legislation is limited at the option of Owner to:

(a) the replacement of the equipment; or

(b) The repair of the equipment

1.4 In no event shall the owner be responsible for any loss of, or damage to property, or death, or injury to persons caused by the equipment, arising out of the use thereof during the period of hire and the Hirer shall indemnify made against the Owner for damages or otherwise, in respect of arising directly or indirectly out of the use of any equipment whilst on hire to the Hirer which indemnity shall extend to and include all costs and expenses incurred by the Owners in investigating and /or defending any such claim.

1.5 The Hirer shall at all times use the Owners equipment properly and in a skilful manner for the purposes intended

1.6 If the Hirer wishes to return the equipment before the end of the Hire Period the Hirer will remain liable for all hire and any other charges payable to the Owner of the entire hire.

1.7 The Hirer shall have a representative attend upon collection of the equipment to supervise the count of the equipment and sign the same out. When the Hirer does not provide a representative to supervise the collection of the equipment the Hirer must accept all counts taken by the Owner.

1.8 Once the original hire period on this contract has expired it will be deemed to still be on hire and a new rehire account for a minimum of 1 month will be issued until the Hirer notifies the Owner in writing to terminate the contract. Rehire rates are subject to change without notice. The equipment remains the responsibility of the Hirer until removed from site by the Owner.

3.0 TOILETS & RELATED PRODUCTS, OFFICE & SITE CONTAINER

3.1 Toilets will be serviced on a fortnightly basis. At the cost of the hirer.

3.2 Cleaning of the toilet that has been knocked down or blown over incurs an

additional fee.

3.3 The toilet is to remain in the original installation position at all times. If the toilet is to be repositioned on the site, this shall be carried out by the Owner at the Hirer’s cost. The equipment is not to be moved by any other person.

3.4 Any graffiti, paint splatter, concrete splatter, dents or damage on the toilet will result in a cleaning/ repair/ fee determined by the Owner.

3.5 The Hirer acknowledges that they or their representatives have received

instructions on the use of the toilet.

4.0 DAMAGE TO EQUIPMENT & MISSING EQUIPMENT

4.1 The Hirer shall at all times keep the equipment in working order and

Condition and will not in any way repair or alter the equipment without prior written consent of the Owner. The Hirer shall be responsible for any loss or damage to the equipment for any reason whatsoever , except damage which is caused by reasonable wear and tear. It is agreed that upon the period of hire, the whole or part of the cost or replacement of, or repair the equipment will be charged to the Hirer at a rate specified by the Owner. Any missing or damaged stock will remain the property of the Owner at all times. Missing stock will be deemed as stolen property.

4.2 Once it has been established by the Owner that the property is missing or damaged, the Owner will re serve the right to charge on going monthly re-hire amounts for the equipment until such time as the missing/damaged stock invoice has been paid in full.

4.3 Any stock stolen will be charged accordingly. Any person or company

found with stolen property will be prosecuted.

5.0 TERMINATION BY THE OWNER

5.1 The Owner may notwithstanding the specified period of hire and not with

standing any waiver of the same previous default forthwith terminate the

agreement and repossess the equipment in any of the following events.

(a) If the Hirer shall commit or permit any act or thing whereby the Owner’s

rights in the equipment may be prejudiced.

(b) If the Hirer should become or be made bankrupt or make arrangement or composition with his creditors, or in the case of a Hirer being as limited company should an order be made or a resolution for the winding up of such company.

(c) If the Hirer commits any breach of this agreement or fails to pay any monies when monies is due. For the purpose of repossessing the equipment, the equipment may enter into, upon any premises where the equipment may be, without prejudice to the rights of the Owner, to recover from the Hirer any monies due here under or any dam ages of breach hereof and the Hirer indemnifies the

Owner in respect of any claims, damages or expenses arising from any action taken under the clause.

5.2 If the Hirer breaches any part of this agreement the Owner reserves the

right to remove equipment on any other individual site without notice,

regardless of payment status.

5.3 If required to tow the toilets DO NOT go over 80km per hour

Generally we can deliver in 24 hours (this time can vary). We can also provide emergency hire.

Please keep in mind, we need to clean and service your toilet or tank on a regular basis – it needs to be accessible.

Toilets for events & parties

We provide from 1 single toilet for a backyard or 150 plus units for a major event. Just think of a backyard party where nobody has to trample dirt and grass through your house to use the toilet.

Things to think about when choosing & hiring

ACCESS to the site for delivery of Unit.

LOCATION you want the unit onsite

Is there a GATE to go through, will the unit fit? Measure it.

Is there a FENCE to go over?

Are there POWER LINES over head?

Are there STAIRS?

Is there a carport? Is there access through it? For delivery AND clean & service.

Is there REAR LANE access?

A fresh water flush toilet HAS to be CRANED onto site, can a truck get CLOSE ENOUGH?

Will the site/access area be clear of building materials?

Location of units on site

Must be where they are easily accessible for cleaning & servicing by a large truck.

Within 10-15 metres of the roadway.

No hazards.

Good clear access is not only better and safer for our operations but also for your workers on site.

BEFORE TOWING THE UNIT

Please check that

• The rear step is folded up and locked into position with the latched on either

side of the step.

• The chain is over the toilet door and the door is locked (in red position).

• Once the trailer is connected to the tow vehicle, ensure that the dolly wheel is

put into locked and upright position.

• The chains on the tow ball end of the trailer are connected to the towing vehicle

with a shackle.

• The trailer electrics cable is connected to the tow vehicle.

• Check the trailer lights are operational.

TOWING OF THE UNIT

• All care must be taken when towing the unit to ensure you know its height and

don’t hit any overheard obstructions during transit.

• Obey all local road rules and ensure you do not exceed the speed limit when

towing the trailer unit.

NOTE: When towing the unit and also moving it around once at your destination, you may notice a trail of water leaking out from the unit. The toilet has an overflow from the fresh water storage tank hidden behind the rear wall of the unit. When you stop, break or travel around corners, fresh water will overflow out of the unit. This is normal. Depending on the distance of your journey you will need to top up the fresh water supply once at your destination to ensure the toilet will flush properly.

ARRIVING AT YOUR DESTINATION

• Once you arrive at your destination, disconnect the unit from the tow vehicle

and put the dolly wheel in the down position.

• Move the unit into the position you require. Do not site on the unit on a steep incline or decline as it will not operate properly and will not be able to be Stabilised.

• Once in position, fold down the rear step and to stabilise the unit wind the dolly

wheel up. This will apply pressure to the rear step and stop the trailer from moving.

• Place the locking pins in the rear step to secure it before using it.

• You may wish to connect power to the unit to use the interior and exterior

lighting. To do so connect a 10amp extensions lead into the socket of the rear

wall of the unit and switch it to the ‘on’ position.

FILLING THE UNIT WITH FRESH WATER

• As the toilet has limited water supply, ask your guests not to flush the toilet

excessively. Men should use the urinal where possible to maximise the amount

of usage from the toilet.

• Using less water increases the amount of guests the unit can handle by reducing the amount of waste entering into the storage tank.

• Fill the main water tank through the drain hole in the hand washing basin. The

main water tank is located within the floor you stand on inside the toilet. Water

from this tank is used for flushing the toilet bowl. Pour water down the drain

hole in the hand washing basin until it overflows on the floor near your feet.

To fill the hand washing water supply, you need to remove the hand washing station lid as follows.

• Press the chrome stud on the front of the hand washing basin.

• Lift the hand washing basin lid by levering upwards at either end until there is

enough room to fit a hose on.

• Fill the reservoir to the top (until you hear/see water overflowing)

NOTE: The fresh water storage compartment for flushing the toilet holds approximately 150 litres of water. The fresh water storage compartment for the hand wash basin holds approximately 50 litres of water. If your toilet does not flush when you operate the hand pump then the fresh water storage compartment in the base of the toilet is empty and requires more water.

ELECTRICITY AND WATER DO NOT MIX

You should make sure that your electrical leads are not located in a position

where they can be wet by water from the unit. You should NOT connect the power supply to the toilet to an outlet which does not have RCD protection. If you are unsure, contact a Licensed Electrician for advice.

Fencing

timely receipt of a notice of legitimate objection or defect, the Owner shall, within

a reasonable time, cure the problem within reason. The liability of the Owner in

respect of any matter arising out of the application of the Trade Practices Act or

any other applicable legislation is limited at the option of Owner to:

(a) the replacement of the equipment; or

(b) The repair of the equipment

1.4 In no event shall the owner be responsible for any loss of, or damage to property, or death, or injury to persons caused by the equipment, arising out of the use thereof during the period of hire and the Hirer shall indemnify made against the Owner for damages or otherwise, in respect of arising directly or indirectly out of the use of any equipment whilst on hire to the Hirer which indemnity shall extend to and include all costs and expenses incurred by the Owners in investigating and/or defending any such claim.

1.5 The Hirer shall at all times use the Owners equipment properly and in a skilful

manner for the purposes intended

1.6 If the Hirer wishes to return the equipment before the end of the Hire Period the Hirer will remain liable for all hire and any other charges payable to the Owner of the entire hire.

1.7 The Hirer shall have a representative attend upon collection of the equipment to supervise the count of the equipment and sign the same out. When the Hirer does not provide a representative to supervise the collection of the equipment the Hirer must accept all counts taken by the Owner.

1.8 Once the original hire period on this contract has expired it will be deemed to still be on hire and a new rehire account for a minimum of 1 month will be issued until the Hirer notifies the Owner in writing to terminate the contract. Rehire rates are subject to change without notice. The equipment remains the responsibility of the Hirer until removed from site by the Owner.

2.0 EQUIPMENT HIRE

2.1 FENCING & RELATED PRODUCTS, ROOF & SAFETY EQUIPMENT

2.2 It is a condition of the Owner that the Owner’s signs shall be placed on a

minimum of every fifth panel for insurance and advertising purposes.

2.3 Any modification by the Hirer, being shade cloth, weed mat, Hessian, signage etc. must be suitably braced and authorised in writing by the Owner, prior to being attached to any of Owner’s products.

2.4 Installation must be subject to written authorisation from the Owner. Upon

collection fencing must be in original installation position and accessible, or appropriate charges will apply.

3.0 DAMAGE TO EQUIPMENT & MISSING EQUIPMENT

3.1 The Hirer shall at all times keep the equipment in working order and

Condition and will not in any way repair or alter the equipment without

prior written consent of the Owner. The Hirer shall be responsible for any

loss or damage to the equipment for any reason whatsoever , except dam

age which is caused by reasonable wear and tear. It is agreed that upon the

period of hire, the whole or part of the cost or replacement of, or repair the

equipment will be charged to the Hirer at a rate specified by the Owner. Any missing or damaged stock will remain the property of the Owner at all times. Missing stock will be deemed as stolen property.

3.2 Once it has been established by the Owner that the property is missing or

damaged, the Owner will reserve the right to charge on going monthly re-hire amounts for the equipment until such time as the missing/damaged stock invoice has been paid in full.

3.3 Any stock stolen will be charged accordingly. Any person or company found with stolen property will be prosecuted.

3.4 Costs for any stolen or damaged parts $85 per panel, $10 per brackets, $30

per base and $35 per stays.

4.0 TERMINATION BY THE OWNER

4.1 The Owner may notwithstanding the specified period of hire and not with

standing any waiver of the same previous default forthwith terminate the

agreement and repossess the equipment in any of the following events.

(a) If the Hirer shall commit or permit any act or thing whereby the Owner’s

rights in the equipment may be prejudiced.

(b) If the Hirer should become or be made bankrupt or make arrangement

or composition with his creditors, or in the case of a Hirer being as limited

company should an order be made or a resolution for the winding up of

such company.

(c) If the Hirer commits any breach of this agreement or fails to pay any

monies when monies is due. For the purpose of repossessing the equipment, the equipment may enter into, upon any premises where the equipment may be, without prejudice to the rights of the Owner, to recover from the Hirer any monies due here under or any dam ages of breach hereof and the Hirer indemnifies the

Owner in respect of any claims, damages or expenses arising from any

action taken under the clause.

4.2 If the Hirer breaches any part of this agreement the Owner reserves the right to remove equipment on any other individual site without notice, regardless of payment status.

Site Office

2.0 SITE OFFICE

2.1 The Site office will be delivered on site including an Air conditioner, 50 litre

fridge, wall hung first aid kit , 4.5 kg fire extinguisher ,shelf ,plan holder with

hooks and one set of keys

2.2 The first aid kit is to be restocked by the owner after the hire and the hirer will

be invoiced for the replacement of used items. It is the hirers responsibility to

restock it during the hire period.

2.3 If the power is turned off to the office you must leave the fridge door open to

avoid mould growth.

2.4 The fire extinguisher should be maintained at all times by the hirer. If used ,damaged, lost or stolen the hirer will be invoiced for the replacement of the item

2.5 The electricity supply to the office is to be arranged by the hirer

2.6 The office is to remain in the original installation position at all times. If the office is to be repositioned on the site, this shall be carried out by the Owner at the Hirer’s cost. The equipment is not to be moved by any other person.

2.7 Any graffiti, paint splatter, concrete splatter, dents or damage on or inside the

Site Office will result in a cleaning/ repair/ fee determined by the Owner.

2.8 Upon collection the office must be clean including the fridge. Power must

be disconnected.

2.9 Failure not to have office ready upon the collection day and time agreed a extra $200.00 fee will be charged.

3.0 DAMAGE TO EQUIPMENT & MISSING EQUIPMENT

3.1 The Hirer shall at all times keep the equipment in working order and

Condition and will not in any way repair or alter the equipment without

prior written consent of the Owner. The Hirer shall be responsible for any

loss or damage to the equipment for any reason whatsoever , except damage which is caused by reasonable wear and tear. It is agreed that upon the period of hire, the whole or part of the cost or replacement of, or repair the equipment will be charged to the Hirer at a rate specified by the Owner.
